To reserve a Membership, applicants must deposit their Enrollment Fee in a third party escrow account (much like a residential property transaction). Escrowed funds will be held on deposit until the next membership is available.

Membership enrollment is subject to satisfaction with program eligibility standards, as further provided by the Membership Application, and subject to the reasonable discretion of the program Manager. Otherwise, memberships will be offered in the order reservations are received, subject to vehicle availability.

Membership is also subject to prior mutual agreement on the terms of the Membership, including Membership description, total sale pricing, closing requirements, and applicable time limits, such as the Membership term, or waiting period, all in accordance with the Membership Agreement. Escrow instructions shall define when escrow will expire and all documents, monies and other items shall be returned to the respective parties entitled thereto: for example, less any fees and charges borne by the escrow agent, or Extreme Car Share. Funds on deposit may be refunded at any time, subject to payment of escrow fees and charges, as provided in the escrow agreement. The escrow agent shall disburse payment to Extreme Car Share only after Member's successful enrollment, as follows.

After deposit of funds in escrow, Membership Application approval, and execution of the Membership Agreement, Member shall be obligated to complete the transaction only if a Membership becomes available. Funds on deposit will be released from escrow and remitted to the seller five (5) days after the Manager gives written notice to the applicant that a Membership is available. If the applicant fails to execute and deliver any and all remaining funds due or closing documents on or before the date set for Membership enrollment, Extreme Car Share shall have the right to terminate Membership by giving written notice of such termination to the applicant and escrow agent. If Extreme Car Share terminates the Membership, the escrow agent shall immediately return the Enrollment Fee deposit to the applicant, less escrow fees and charges.
